Reply just in from my solicitor, Finding the developers solicitor very cagey ,and still waiting a responce to the documents and evidence of payments sent . Cracker

Hi just had email from solicitor saying she has had a responce from the developers lawyers : basically saying they are a present drafting another letter to be sent to me either by post or email. apparantly still wanting paymentfor the missing instalments that we all paid to the sales agents or more proof of payment {i have already sent my banK statements and the relevant info from BDL } and again giving me two options :GIVE THEM PROOF OR SIGN THE NOTARY AGREEING TO PAY THE MISSING MONIES ALREADY PAID} hopefully my solicitor has got this wrong ,if not we have waited another 4 weeks to get more b....s...t. payments
Hi I have just received similar email from my solicitor saying that they still want proof from BD that payments were sent otherwise we will have to pay again. Just feel like going round in circles. She did say that other people had managed to send on proof of payments made and had got sorted out. Has anyone managed this???

Hi all I too am in the same situation. Bought via Property Find but then BD took over. Have sent my bank statements etc to my solicitors as proof of the money paid by me and amounting to the contracted purchase price. The commission should not have been taken out of our money before being passed on to Developer and I never knew of any contract between BD and the Developer until Savina sent a copy of it following my Solicitor's demanding clarification. As a contract between them does exist, the Developer should not be looking for extra money now and should have factored in receiving less money after their agent, BD took commission. Hoping to complete soon plus have worked out the loss of rental revenue for last ski season and this summer due to late completion. The lack of administration efficiency surely means the Developer is in breach of contract.

All This is the latest news i have just had from my surveyor who was out there yesterday. I do have some photos as well if anyone wants me to email them. As far as the developer goes my solicitor has been in contact with them to try and resolve the situation but i am waiting to speak to him next week. Thanks Dave Hi David, I managed to visit the development yesterday. The complex is advancing and currently a parking lot is being built for the owners. Your block is finished. Yes, there were people working. Some of the snags in your apartment were rectified. Work on the remaining snags started while I was there under the instruction of the technical supervisor onsite. I will send you a follow up report tomorrow with photos of the snags which were rectified. I will be able to make a final check during my next visit to Bansko. I have received assurances from the supervisor that all reasonable snags will be rectified. Work on the hotel is frozen at the moment and they hope tor resume later in the year. Hi TrevB I will try to scan the copy of the contract that was sent to me so I can post on here, is that possible? I assume this, like me, is the first anyone else has heard of such a contract. Incidently, my Mum and Dad got a look at my apartment and Development last week when they were in Bansko. He said it looks really well but some items were missing, like the cooker top, oven, wasking machine. breakfast bar and shower cubicle (wet room effect instead). I contacted Savina who assures me this will all be put in place. My Dad has also bought apartments in Majestic Pirin which are behind schedule and won't complete on time. His Developer met them personally and showed them progress when they were there. He has also received written confirmation that the Developer has waived the final 10% payment and will be giving compensation for the delay and loss in rental revenue! What a difference!!!

Contract between Developers and their Agent
Hi all I can't work out how to attach the scanned contract on here so if anyone would like to see it just send me a pm with your e-mail address and I will send it to you. To my mind the contract proves that the Developers were aware that the Agent's commission would be taken before forwarding our money to them, therefore, they ARE aware that they would not be receiving the full purchase price and should not be pressuring us for more money.

Hi All, I have had some progress on my apartment. I've had a note from the Solicitor and from Savina confirming that they are ready to transfer my apartment over to me, being in agreement that I have paid all monies due. I have been sent some further pics showing that the appliances have been installed and that some of the more obvious issues in the apartment have been rectified. I am still owed a reasonable amount of cash as I overpaid based on the last statement, though. I'm now arranging the snagging company to complete their inspection and hopefully I can finally get my keys. I wonder if anyone else has had any success in getting any closer? cheers Steve

A friend of mine has also purchased here and has serious snagging issues with the place. She went out herself and found her apartment 20 square metres smaller than was quoted in the contract. She was told the hotel is 2 yrs from completion and the place is un-inhabitable for the foreseeable. Her Spanish based lawyer is not helping one bit and comes up with alsorts of excuses. I have the same lawyer and am having trouble getting any information from them. I'm still waiting to hear if all my payments have been received from Global invest! I want to put an end to my nightmare and wish for a full refund which I know is extremely unlikely. My friend is looking at taking on the services of a UK lawyer and seeing where she can go with them. Is there anyone else on here as unhappy as we are and no longer want to proceed and take on the apartment? If so, get in touch and the more people (as a group) using a UK lawyer the better.

Hi I am also having problems in that the Developer is trying to claim I owe more money now. They are trying to claim back the commission from the buyers that their agent took from payments. The Developer has been completely incompetent in the management of their appointed agents. They knew they would receive less than the purchase price for each apartment because they had agreed that their Agents could take the commission from our money before passing it on. How is your friend getting on with advice from a UK lawyer?
