Good infor mattD20, WILL TAKE THIS onboard. Agree with the offplan game FULLY. First time ive invested via Offplan as LTD resales around in sept 05 Back to the art15/16 My contract for PRESPA states art15 for final payment + 6MTS grace, no mention of art16 anywhere in the PC but does state "ready for use" I feel ditto NEW INN for PRESPA Prespa completion date Aug 07 (Assume completes on time) ART 16 "ready for use" March 08 End of Ski season therefore Maint payments thro summer .... Not looking good Alright in my LTD defence, ART15 meant nothing at kick off neither my Agent or Solicitor mentioned this & who was I to question at this stage COMPLETION to me means "ready for use" So commeth the email from Achadia for FP I will be approaching them to re-consider there payment plan. Also for the folk who have furnished prior to Art16 or Art15 were there any security problems/damage

MattD20, Who did you getto the Technical survey - maybe worth rest of off organising this together for our apartments. It may save a bit if they make one visit and do all our apartments at the same time. Any thoughts?

Hi all I have bought at the new inn and made the final payment ages ago. My solicitor thinks that I will still be able to claim the compensation money for the delay, at least from the time I made the final payment. Reading the other posts on here I am not sure if this is going to be the case. Does anyone have any information on the other facilities that were supposed to be included in the development, the gym, sauna etc are they still going to be included?

Hi Jesica nice to here from you. As for compensation i think no chance. Off Plan is a big risk and is only to help the Builder as we pay in advance before he even starts. We take all the risks and they take no risk. I recoment you get a Technical Inspection as the Engineer will find Defects and bad workmanship, they did in my apartment and will not get the final payment untill all work is complete and fixed in my apartment and is Re Inspected by the same Civil Engineer which will be money well spent. As you have allready paid your final payment I think you will have great difficulty in getting them to fix anything as they have your money so why bother after all we are 1000s of miles away. You have to play the game so to speak unfortunatly English people are not very street wise compared to Bulgarians. What time do they say the development will be finished they told me November 15th. Also they are not Advertising and taking bookings for the next Ski Season What can we do about that do you think? One thing is for sure if we do nothing they surley will too.

It looks like you are the first Bulgarian having bought an apartment in the Gramadeto area :wink: Respect :!: Maybe you can tell Jesica where to find the Engineer with the Technical Inspection? But maybe you are Greek, in which case I apologise and say the contrary :D

Hi matt I am hoping to withhold all maintenance payments until any problems are corrected. Do you have the name of the engineer who is going to inspect your apartment? Any idea how much this will cost? thanks Jessica

Hi Jesica I paid 200 euro for the technical inspection money well spent as far as I am concerned. The details are on page 11 of this Forum. regards matt.

oops thanks Matt I can see the details now!! Pilotpaul my solicitor is Bulgarian, recommended on this site awhile back. He seems pretty switched on, he got the prelim contract rewritten for me as soon as I contacted him (can't remember what the changes were sorry).

Hi, Forgot to check forum for a while. Bit stupid as been some useful stuff. Re article 15, I checked this with my solicitor. She said, as Frank did, they can ask for payment as it states this is the point when we have to pay in the contract. She is unsure how they managed to get it so early (probably paid someone off) but the fact is they have it. I asked her to pursue penalty issue for late completion but of course Lakon refused. She said I could sue for it, but said they could counter sue for me paying last installment late as they asked for it in October 06(though I don't think I was ever asked until that email a few weeks ago! When was anyone else first asked for it??). She advised if I was to sue I should pay for aprartment and sign at notary first. Obviously concern is pissing them around when I don't fully own apartment. So I was about to pay as I just want to get it out the way now anyway, though this technical survey thing has concerned me. Don't want to pay if there are faults. So I may see if I can get this done. My plan is to go out there mid sept and sign at notary. Solicitor representing me will be there as well.

do not make final payment until technical inspection as they rest assured will find many faults and if you owe them money they will fix it to get the final payment out of you so play the game. this message is for everybody who is buying apartments at the new inn.

Matt, Can I just ask what they found wrong in your apartment? Just thinking that this survey is 200 euros plus inspection after will be a total bill of 300-400 euros. Obviously worth it if loads wrong. But I got a studio, so basically one room plus bathroom, and I didn't have a kitchen fitted which I guess is the kind of thing thats easy to mess up (though I guess a messed up bathroom could be a problem). Surely they can't go that wrong with that! I would have thought if its a few minor things I'd be better of risking them fixing it or withholding maintenance payments than paying 400 euros on the inspection. By the way, if I go out sept I don't mind looking at anyones apartment and taking pictures if you want. If you want to arrange with lakon that you've given me permission etc. Can't guarantee I can do it but can try.

Can I suggest that we hold of contacting this surveyor individually and waited until the apartments can actually be used and trying for a group discount. It must be far easier for him to go to the New Inn once and have a look at a lot of apartments than keep making several trips so there should be quite a good discount to be negotiated!
