I recently enquired with Teodor about Art 16 and he confirmed they don't have it. He says this means we can use the apartment and rent it out privately but not rent it through a tour operator, or so he says. I'm not sure how the new Lakon rental co. can be in talks with tour operators regarding rental without Art 16.

I was wondering....if a fire breaks out in the building and it is proved that it was accidently caused by faulty electrics or somthing like that. But it was also revealed that it started in the aparment where people were staying without Article 16 been issued. I guess our insurance wouldnt be worth the paper it is written.
They would simply turn around and say no one should have been staying there, the building hasnt been proved to be habitable, your insurance is void.
I am going to speak to my solicitor about jennies comments with regard to what Teodor has said.

Looks like it's just the three of us that have any interest left in the New Inn. Everyone else seems to have given up on the forum.
Maybe everyone else has had the sense to pull out, They have all got there money back and its just us 3 wise monkeys left ;-)
I got a reply from Teodor about article 16. He basically said it is out of their hands - that they finished contruction a while ago and are waiting on the authorities to check them.
I've asked about the leisure facilities a few times now, and he never answers anything about. I can only assume that means rather predictably that they are never going to materialise.
I'm more bothered about that than article 16 as that will come eventually. But with no facilities, thats a serious knock to value of the appt, rentability, resale etc. Most other developments now have a lot or at least some facilties.
I have just checked my original contract and the original sales literature. The sales lit says there will be an outdoor bbq but the contract makes no mention of any facilities whatsoever.
I seem to remember the sauna etc was an add on on later sales details. Can anyone confirm what facilities were suggested would be included at the New Inn?

Seems I've already had this conversation with Teodor - Basically nothing is in the contract so that is what they have to provide - nothing! My agents website talks about a gym, sauna and swimming pool but I have just read his disclaimer (which I wish I had read three years ago but then I'm a trusting (for trusting read naive) sort of chap) which basically says that nothing they say has to be true and it is an unregulated industry so you can't complain to anybody so tough! Yet another example of how we have all been screwed! So even when or if we ever get article 16 the apartments will not appeal to tour operators or individuals as a rental option as there is so much choice in Bansko nor will they appeal particularly to a prospective purchaser - even if you could find one. Just to make things worse for myself I bought Bradford and Bingley shares the other week. Why do I always get it so so wrong?????
I did get a reply from theodor re facilities, though it took an email to my agents who then contacted him to get it.
Anyway, he said there is still a plan for a building, which will have restaurant, reception, ski equip storage room, and a spa. Again, he blamed the municipality for not granting the permit yet.
Whether any of that is true, or just a ploy to get final payments, maintenance payments etc is anyones guess. I know someone who has met teodor said he is quite genuine on here so its probably not down to him, but I'll believe it when I see it.
I was told 100% there was going to be a pool 5 months ago, and when I questioned whether that was definate with my agents, Balkan Ski Chalets, was given a dirty look and told "why should they lie?"...mmm. (edited) Have a feeling if any facilities do ever appear they'll likely be pretty pityful.
Hi, does anybody have any idea as to how many of us are paid up in full, part paid or have got any money back? Is anybody actually using or renting out their apartment?

Don't know for sure - don't suppose anybody except Teodor knows but my guess is that most people have paid in full and that nobody has got their money back. Don't see how anybody can rent it out as it is and without Art16.
I'm with PRESPA not happy & feel that the facilities will not happen, & in general feel Bansko has lost the plot REGARDING AN INVESTMENT after what I saw as a lot of early promise back in 2005 and as yet not issued final payment in fact trying to negotiate a termination settlement, Prespa Legal have being in contact via Email but as yet no conclusion, so it seems we have got to the silent no response obviously because we keep
turning down they offer of extended time to pay up & we keep quoting the contract Terms & conditions..
Even the different solicitor we contacted Konstantin via Sun Homes as usually says the offer from Archadia for prolongation is good & stated "You
will lose less if you complete & then re sell " when we said no he offered to send a letter of objection to Archadia for a fee of 11000 EURO, we said
no thanks (Money down the drain).
Sun-Homes our agents are sympathetic & agree with our interpretation of the contract
but they is very little they can do & really don't expect them to be accountable.
So will sit it out will not spend a penny more on what WE think is a dead loss & going the legal direction will cost a lot for little or no gain we are
25-30k in with what we see as 25-30k yet to spend (inc Fees & furnish etc) & the increasing posts on ridiculous maint & utility fees + no sign of the ski
zone being increased /improved don't encourage us to proceed.
i see that the old inn has now got art 16, do you reckon the new inn must have as well??

Hi Paul,
As you may remember, I am buying at the Old Inn and I can confirm that Art 16 was issued about 1 week ago for my apartment.
The promised Spa has not yet started and Archadia say that they want final payments to cover the cost of installation but say thay want to complete it before the winter season.
I am going through the legal side in the UK for POA's etc but have not completed final handover and am in no hurry, to do so. I expect management costs will start the following day.
