So is anyone disputing the 12 euro charge, or is everyone gonna bite the bullet and just pay?

Hi Flatlander I have not even heard of the 12 Euro Maintenance charge but one thing is for sure if there are no or very few faclities I will not be paying that much. For example there is no pool to maintain ect. :!:

Maintenance Contract
We are also in receipt of a contract for management and maintenance, is anybody able to clarify a number of points regarding this contract: i.) Art 1.2 regarding the "management" of the apartment, are we obliged to use the services of Lakon or is this something that we could undertake. ii) Art 5 refers to the annual fee for maintenance which I understood was 7 euros per square metre at the time of purchase, according to this contract it is now 12 euros. Can they impose such an increase. iii.) Art 11 is a fee of 245 euros payable for the "management" as refferred to at Art 1.2 again are we obliged to use their service. iv.) Art 12 states that we have to pay a deposit of 300 euros for payment of personal bills, electricity, water etc. Again why can we not pay these ourselves. v.) Art 14 states we are due 100 euros for the opening of individual accounts. Where does this come from. vi) Art 17.2 refers to non-payment of the fee pursuant to Art11-14, can any one explain this. I am not at all happy with the hidden costs that have now become apparent with this contract. I look forward to any response.

No, you can have the management part removed which is what I am doing. ii) Art 5 refers to the annual fee for maintenance which I understood was 7 euros per square metre at the time of purchase, according to this contract it is now 12 euros. Can they impose such an increase. Legally I guess they can't as its 7 in preliminary contract. Not quite sure what they'd do though if people didn't. Maybe like Daz said they'd stop maintaining it properly. I wouldn't mind paying it if they had built the facilities as I was told many developers underestimated the costs, but hiking this up with no warning and having no facilities is taking the p*** to say the least. iii.) Art 11 is a fee of 245 euros payable for the "management" as refferred to at Art 1.2 again are we obliged to use their service. As above, no not if you use your own management. iv.) Art 12 states that we have to pay a deposit of 300 euros for payment of personal bills, electricity, water etc. Again why can we not pay these ourselves. Thanks for your help, I did ask our solicitor these questions but she said if we wished to discuss the agreement it would be a 300euros fee. What is everybody else out there doing regarding trying to get rentals?

Has everybody paid for their apartments now? I haven't paid my last instalment as I agreed with Teodor that I could wait for Art 16. although I recently received the e-mail to say that Art 16 had been granted I did not receive from him a request for the final instalment until this arrived yesterday: Lakon LTD. still haven’t received your last payment for your apartment in our complex! I need to inform you that we work very intesively with finding new customers for our projects! I need to inform you that according to the preliminary contract we have the right to terminate the contract and you will loose your apartment! We found potenital clients and we are going to sell our apartments if we agree with them! The apartment in The New Inn is property which is on the name of LAKON LTD. and there is no legal problem it to be sold to other people! We just need to inform you that we terminate the contract and nothing else! Please inform me what happened with your last installment! Why do they have to be so nasty? I really feel that I don't want anything more to do with these people, especially after they have increased the maintainance charge by so much. At the moment taking ownership of the apartment just seems like writing a blank cheque. I already have an apartment at Sunny Beach and despite a contract with Balkan Holidays the rentals are returning about 1.5%, so they only really cover the running costs - and God only knows how much the electricity will cost for heating if you do ever rent out your New Inn apartment. It wasn't supposed to be like this!!!

Well I think its safe to say the chances of them finding someone else to buy it are unfortunately slim. I paid my last installment last year.

Hi pilotpaul I agree with you on the electric and heating charges, me personally have decided not to connect water electric has i dont need my apartment. I bought to rent and hopefully make money when i sell in years to come, but reading comments on this site it's probabl better to leave empty

Hi all I think for now I am also going to leave my apartment empty. I was promised 5% of the purchase price back for late completion and the Developer signed the Contract to this Effect. The Deadline was 30th December 2007. Therefore I will pay No Maintanance Charge nor Ever unless I get my 5% back as per contract. It can stay Empty so at least all I have to pay in my Insurance.

Hi Matt, you dont need to pay insurance if you dont put any furniture in the apartment

You don't need contents insurance but you certainly need buildings insurance!!!

Yes of course you need building insurance, but what would happen if people refused to pay there maintence. Maybe Frank can tell us!

Forgive me for repeating myself, Simple answer will be IF YOU DONT PAY HOW CAN THE DEVELOPMENT BE MAINTAINED, THE DEVELOPMENT THEREFORE FALLS INTO DISREPAIR. AND/OR The utilities get cut off or worst case as in UK when owning a flat & fail to pay the management fees the leaseholder will start proceeding's to repossess the flat. BOTTOM LINE YOU ARE HAD BY THE BALLS.

Hi all as regards not paying the maintenance charge. As long as one has not signed the Maintenance Contract they can not repossess an Apartment. That is a fact if however one signes the contract then maybe they can. Also for 12 euro per m2 you should get a pool, Gym, restaraunt and so on if you do not then you are paying the same as every body else that is. So think about what you are doing. Remember once you sign a contract there is no going back and they will have no need to bother putting in a gym etc. Obviously Bulgarians are much more inteligent than the English. :!:

Please check your Prelim Contract and tell me WHERE IT STATES A pool, Gym, restaraunt and so on IS INCLUDED
